As AI adoption accelerates across the continent, the absence of mature regulatory frameworks is both an opportunity and a risk. Here's how forward-thinking organisations are building responsibly without waiting for governments to catch up.


AI Governance in Africa: Building Responsibly in an Underregulated Landscape

One of the most common statements I hear from enterprise clients across East Africa is: "There aren't really any AI regulations here yet, so we have some flexibility."

It's technically true. Kenya, Tanzania, Uganda, and most of sub-Saharan Africa do not yet have comprehensive AI-specific legislation. The EU's AI Act, the US Executive Order on AI, and China's AI governance frameworks don't apply here. For organisations racing to deploy AI, this can feel like freedom.

I'd encourage a different framing: the absence of regulation is an opportunity to build well from the start, not permission to build carelessly.

Here's why that matters — and what responsible AI governance looks like in practice for organisations in the region.

Why Governance Matters Before Regulation Arrives

Regulation is coming, and retrofitting is expensive

Several African countries are actively developing AI frameworks. Kenya's Data Protection Act (2019) already provides meaningful constraints on personal data processing. Nigeria, South Africa, and Egypt have published AI strategy documents with regulatory intent. The African Union released a Continental AI Strategy in 2024.

Organisations that build AI systems without governance foundations today will face expensive retrofitting when these frameworks crystallise. The cost of building responsibly from the start is a fraction of the cost of redesigning systems to meet compliance requirements after the fact.

Reputational risk is global

If your organisation operates at any international scale, customers and partners increasingly expect AI governance documentation. Enterprise procurement processes in Europe, North America, and the Gulf now routinely ask for evidence of AI risk management practices. Being unable to demonstrate that your AI systems are governed costs deals.

Your users deserve it regardless

The customers and employees whose lives are affected by AI systems — loan applicants, job candidates, patients, students — deserve protection regardless of whether a regulator mandates it. This is the ethical foundation that good governance sits on, and it's worth stating clearly.

The Core Elements of AI Governance

Governance doesn't need to be a 200-page policy document. For most organisations at early stages of AI adoption, it means having clear, documented answers to these questions:

1. What decisions is the AI making or influencing?

Categorise your AI systems by the nature of their impact:

Low risk: Internal productivity tools, content generation, search and summarisation. Minimal governance overhead required.

Medium risk: Customer-facing assistants, recommendation systems, process automation with human review. Requires documentation, monitoring, and escalation paths.

High risk: Credit decisions, hiring screening, medical triage, law enforcement applications. Requires rigorous testing for bias, mandatory human oversight, audit trails, and explicit user disclosure.

Most organisations are surprised to find some of their "basic" AI deployments qualify as medium or high risk once they think through the decision chain.

2. What data are you using and where does it come from?

Every AI system that handles personal data requires data governance:

  • Documented legal basis for collection and use
  • Data minimisation (use only what you need)
  • Retention and deletion policies
  • Data residency — where is the data processed and stored?

For Azure deployments, the last point has a concrete answer: Azure's data residency options allow you to keep data in specific geographic regions, and the contractual guarantees in the Microsoft Data Protection Addendum provide a strong foundation for compliance documentation.

3. How do you handle errors and bias?

All AI systems make mistakes. Governance requires:

  • Testing your system on diverse populations before deployment, not just on your development team's data
  • Monitoring for performance degradation over time
  • Clear escalation paths when users believe the AI has made an error
  • Documented processes for correcting errors and updating the system

Bias testing is particularly important in African contexts where training data for AI systems is often skewed toward Western populations. A model trained primarily on English-language data from the US or UK will perform differently on Kenyan English, Swahili-influenced communication styles, or multilingual contexts.

4. Are users informed they're interacting with AI?

This is both an ethical requirement and an increasingly legal one. Users should know:

  • That they're interacting with an AI system
  • What the AI can and cannot do
  • How to reach a human if needed
  • What the AI does with their information

5. Who is accountable?

Every AI system should have a named human accountable for its performance and responsible for its governance. This is often called an "AI Product Owner" or AI Responsible Person. Without named accountability, governance documents sit in a drawer and monitoring doesn't happen.

A Practical Starting Point

You don't need a dedicated AI ethics team to start. Most organisations can begin with:

  1. An AI inventory — a spreadsheet listing every AI system in use, what decisions it influences, and what data it uses. You can't govern what you haven't catalogued.

  2. A simple risk categorisation — low / medium / high based on the decision impact framework above.

  3. A monitoring commitment — for every medium and high risk system, a commitment to review performance metrics quarterly.

  4. User disclosure — adding clear disclosure to every customer-facing AI interface.

This takes a few days of focused effort. It's not comprehensive governance — but it's a foundation you can build on, and it's vastly better than nothing.

The Opportunity in Getting This Right

Africa has a genuine opportunity here. Countries and organisations that build thoughtful AI governance frameworks — not as box-ticking compliance, but as substantive practice — will have a competitive advantage as global standards crystallise.

The African Union's AI strategy explicitly positions Africa as wanting to shape global AI governance norms, not just adopt them. For individual organisations, that means the same thing in practice: help set the standard rather than scramble to meet standards set elsewhere.
